1. APPLICATION
   1. These General Terms and Conditions apply to all visitors to the Bernardinos website, www.bernardinos.com (hereinafter referred to as the "Site") and to any other commercial transaction carried out through the Site's online store.
      Browsing the site, as well as purchasing any product through it, implies acceptance of these General Terms and Conditions of Contract and Use by the User and the Customer.
      Before ordering any product on our Site, please read these Terms carefully and print or save a copy for future reference.
      Bernardinos reserves the right to review and amend the General Terms and Conditions at any time without notice. prior notice, it being understood that they comply with the provisions of Decree-Law 24/2014, of 17-02, as amended by Law 47/2014, of 28-07.
2. INFORMATION ABOUT CONTENT

      The reproduction, transfer, distribution or storage of the contents of the website www.bernardinos.com without prior written authorization granted by Bernardinos is prohibited for purposes other than strictly personal use.
      Every effort has been made to ensure that the information presented is free of typographical errors. However, should these occur, Bernardinos will proceed to correct them as soon as possible. Obvious errors, such as pricing, calculation, or typographical errors in offers, promotions, folders, brochures, catalogs, order confirmations, invoices, and other written statements from Bernardinos are not binding.
      The product photographs shown on the website are for illustrative purposes only. As such, Bernardinos recommends that the Customer consult the detailed product description to obtain complete information about its characteristics, as well as request more precise information if they so wish.
3. OFFER AND AGREEMENT
   1. The offers and promotions on the Website do not imply any obligation. By completing your order on the Website, you are making a binding offer to purchase the product(s). All orders are subject to acceptance by Bernardinos, and the agreement between you and Bernardinos will only be formalized when Bernardinos begins to fulfill the Contract. If the ordered products are no longer available or are out of stock, Bernardinos will inform you of this fact and reject the order. If possible, we can suggest other products of similar nature and quality as a replacement.
   2. The prices shown are in euros. The availability of the products shown on the Site is limited to the stock available at any given time.
4. DELIVERY COSTS
   1. Shipping costs will be charged for the delivery of the ordered Products. There is no possibility of refusing delivery or the costs related to it.
   The delivery cost is indicated on the Website.
   2. PRICES, PAYMENT

   3. The applicable prices are the prices of the products displayed on the Website. All products include the price with and without VAT in Euros. Delivery costs, as well as all other additional costs, are indicated separately on the Website. Payments can be made by: a) Bank Transfer b) MbWay c) Multibanco References d) Credit Card e) Bank Credit In specific cases, Bernardinos may restrict payment to Bank Transfer only. Bank Transfer: After placing your order, you will receive a confirmation email that includes Bernardinos' bank details so you can proceed with the transfer. After completing the transfer, please send an email to cliente@bernardinos.pt with proof or confirmation, mentioning the order number. Bank details will be provided at checkout on the website. Your order will be processed as soon as we receive payment if you choose bank transfer. PayPal After completing your order, the payment procedure will begin. If you choose this payment method, you will be redirected to the PayPal page where you can confirm your purchase. Multibanco Reference After completing your order and initiating the payment procedure, if you choose this payment method, the necessary references to complete the payment will be provided to the customer. The order will be processed as soon as we receive confirmation of payment, in either modality. Discounts The validity period of the promotions presented is available on all product pages; simply click on "promotion info" next to the product page. Promotion.
   4. Promotional discounts will be applied on the condition that the order is finalized by the User through the “checkout” and paid for by the end of the advertised period.
   5. Saving a product in the “shopping cart” does not guarantee its price or discount if the conditions set out in the previous point are not met.
5. DELIVERY / COLLECTION
   1. Bernardinos will endeavor to inform you of the expected delivery dates as soon as the order is completed, but the maximum delivery time will never exceed 20 days.
   2. The delivery period begins on the day the contract is concluded, as provided for in article 3.1., unless expressly agreed otherwise between the parties.
   3. If any item is damaged or missing from your order, please contact us at 232 424 626 or customer@bernardinos.pt, within 5 days of delivery. If any product is damaged upon delivery, the delivery person must be informed. The product will be collected within 14 days from the day the Customer contacts us, unless otherwise specifically agreed.
   4. Products are delivered to the location specified when the order is placed. Ownership of the goods passes to the Customer upon full payment of the price and any other amount. The risk of loss or damage to the goods is transferred to the Customer upon delivery.
   5. Products will be delivered (by a carrier) to the address indicated by the Customer. If you choose to place your order in more than one ordering process, different delivery times may apply.
   6. Mainland Delivery
      1. Deliveries are made between 9:00 AM and 6:30 PM, and it is not possible to specify the exact time. The day before your order is shipped, you will receive an email with the invoice and more information about the shipping and delivery conditions. Products will only be delivered in person and cannot be left in entrances, porches, or other places outside the house.
   7. Island Delivery
      1. Shipments are usually made by the carrier that Bernardinos works with. Shipping costs are calculated on a case-by-case basis.
      Upon order confirmation, the Customer will be informed of the amount.
      2. WARRANTY/CLAIMS
         Article 4 of Decree-Law 24/2014, of 17-02, as amended by Law 47/2014, of 28-07 The Customer always has the legal rights of warranty, for equipment to which the law requires it, for a period of three years from the delivery of the product, under the terms and conditions of the law. If you wish to make a claim under an additional warranty provided by Bernardinos, you must inform Bernardinos of the defect as soon as possible and, at the latest, within 2 (two) months after it was reasonably possible to discover the defect, otherwise you will lose the right to make any claim under the warranty. Claims relating to perishable products must be made within 48 (forty-eight) hours of delivery.
      3. Under Bernardinos' additional warranty for its own-brand products, claims may be made regarding defects in material or workmanship. A valid claim gives rise to free repair or replacement of the Products, at Bernardinos' discretion. If repair or replacement is not possible or reasonable, taking into account the costs involved, Bernardinos is entitled, as a final remedy, to reimburse the costs.
      4. After reporting the defect, the Customer must allow Bernardinos to inspect the Products. The inspection of the defective Product takes place at Bernardinos' premises.
      Transportation/return costs are the responsibility of Bernardinos, unless the warranty claim is denied, in which case the Customer must pay the transportation costs. Any defects in the Products resulting from normal wear and tear or any other external cause, such as, but not limited to, damage during transport carried out by the Customer, incorrect use, or if the Customer has made any repairs to the product without the prior written authorization of Bernardinos, will not be covered by the warranty, unless such use or repairs are inherent to the use of the Products. LIABILITY AND INDEMNIFICATION Article 4 of Decree-Law 24/2014, of 17-02, as amended by Law 47/2014, of 28-07. Bernardinos' liability is limited to the extent permitted by law. Bernardinos will never be liable for any damage to the Customer if: The damage results from non-compliance with the producer's liability, unless Bernardinos is legally liable under the law; The damage is indirect and/or consequential. In the event of damage, the Customer is obliged to limit, as far as reasonably possible, any additional or other damage. RIGHT OF RETURN / CANCELLATION Articles 4, 10 to 14 and 17 of Decree-Law 24/2014, of 17-02, as amended by Law 47/2014, of 28-07 The Customer has the right to cancel/terminate the contract within the period of 14 days from the day on which the Customer, or a third party on their behalf, acquires physical possession of the goods, or of the last good in the case of several goods ordered in a single order and delivered separately. You may exercise the right of withdrawal by sending it to: Bernardinos, Estrada Nacional nº 231 Fração A, Cabanões, 3500-883 Viseu, indicating your decision to withdraw from this contract by an unequivocal statement (e.g., a letter sent by post, fax or email), to be sent before the deadline referred to in the previous paragraph. You may use the attached model withdrawal form.

      Effects of Cancellation
      
      If the Customer cancels the contract, we will reimburse all payments received, including delivery costs (except for additional costs resulting from choosing a type of delivery other than the cheapest standard delivery option offered by us), without undue delay and, in any case, within 14 days from the day on which we are informed of the decision to cancel this contract. We will make the reimbursement using the same means of payment used in the initial transaction, unless expressly agreed otherwise, within a maximum of 5 working days. In any case, the Customer will not incur any costs as a result of this reimbursement. We reserve the right to withhold reimbursement until we have received the returned Products or until proof of shipment of the items has been provided, whichever occurs first.

      Return of items

      If the Customer chooses to exercise the right of withdrawal, the Customer is responsible for the cost of returning the goods.

      Liability and Warranty

      The Customer is only liable for any diminished value of the goods resulting from handling other than what is necessary to establish the nature, characteristics and functioning of the goods.

      5. To exercise the right of withdrawal, you can use the model withdrawal form attached to these Terms, which can also be found on the Website. Alternatively, you may withdraw from the contract by issuing an unequivocal statement to Bernardinos declaring that you wish to withdraw from the contract.
      6. All products containing used consumables can only be exchanged/returned upon replacement of these consumables.
         Bernardinos reserves the right to charge/retain the costs for the contents of these consumables used by the Customer. Your right of withdrawal does not apply to: the supply of products made to the consumer's specifications or clearly personalized; the supply of products liable to deteriorate rapidly; the supply of products that cannot be returned for reasons of health protection or hygiene and which have been unsealed after delivery; the supply of sealed audio or video recordings or sealed software which have been unsealed after delivery; the supply of digital content not supplied on a tangible medium if performance has begun with the consumer's prior express consent and acknowledgment that this means the consumer loses their right of withdrawal; unsealed cartridges and other consumables not described in clause 10.3, unless they are defective.
